1. Agreement to Terms

By accessing or using the ReleaseQA platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

ReleaseQA provides a test results aggregation, quality analytics, and release readiness platform. The Service includes web dashboards, API endpoints, reporter packages, CI/CD integrations, and related tools for managing software quality data.

3. Account Registration

You must provide accurate and complete registration information.
You are responsible for safeguarding your account credentials and API keys.
You must notify us immediately of any unauthorized use of your account.
One person or organization may not maintain more than one free account.

4. Subscription Plans & Billing

ReleaseQA offers Free, Pro, Team, and Enterprise plans. Paid subscriptions are billed monthly or annually through Stripe. You authorize us to charge your payment method on a recurring basis.

Plan limits: Each plan includes usage limits for test runs, seats, projects, and API keys. Exceeding limits requires a plan upgrade.
Upgrades: Plan upgrades take effect immediately. The prorated amount is charged at the time of upgrade.
Downgrades: Plan downgrades take effect at the end of the current billing period.
Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds for partial months.
Grace period: If a payment fails, you will have a 7-day grace period to update your payment method before service is restricted.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or other accounts
Interfere with or disrupt the Service or servers
Reverse engineer, decompile, or disassemble any part of the Service
Transmit malware, viruses, or other harmful code
Exceed rate limits or abuse the API through automated means
Resell or redistribute the Service without authorization
Use the Service to store or transmit sensitive personal data (PII, PHI) beyond what is required for testing metadata

6. Your Data

You retain ownership of all data you submit to the Service ("Your Data"). You grant us a limited license to process Your Data solely to provide and improve the Service.

Data isolation: Your Data is isolated within your organization. Other organizations cannot access it.
Data export: You may export Your Data at any time through the dashboard or API.
Data deletion: Upon account termination, Your Data will be deleted within 30 days. Enterprise customers may request immediate deletion.

7. API & Integration Terms

API keys are confidential. Do not expose them in client-side code or public repositories.
API rate limits are enforced per plan. Requests exceeding limits receive HTTP 429 responses.
We may throttle or suspend API access if we detect abuse or excessive load.
Webhook endpoints you register must use HTTPS and validate HMAC-SHA256 signatures.

8. Intellectual Property

The Service, including its codebase, design, logos, and documentation, is owned by ReleaseQA and protected by intellectual property laws. Reporter packages published under open-source licenses are governed by their respective licenses.

9. Service Availability

We target 99.9% uptime for the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. Enterprise plans include SLA commitments documented in the Enterprise Agreement.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELEASEQA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Indemnification

You agree to indemnify and hold harmless ReleaseQA from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may terminate your account at any time through the dashboard settings. Sections that by their nature should survive termination (including 6, 10, 11, 12) will survive.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
